Welcome to Nouta. These Terms of Service ("Terms") govern your access to and use of the Nouta mobile application and website (the "Service"), provided by RegenBlau OG ("we," "us," or "our"), based in Vienna, Austria.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

• Age: You must be at least 16 years old to use Nouta.

• Magic Links: Nouta uses "magic links" for authentication. You are responsible for maintaining the security of your email account. Any activity under your Nouta account is your responsibility.

• Accuracy: You agree to provide accurate information when creating your profile.

2. Health and Safety Disclaimer (IMPORTANT)

• Not Medical Advice: Nouta is a tool for logging workouts. We do not provide medical, health, or professional fitness advice.

• Train at Your Own Risk: Physical exercise involves risk of injury. You should consult a physician before starting any new exercise program. You acknowledge that you use Nouta and perform any exercises at your own absolute risk. * Assumption of Risk: RegenBlau OG is not responsible for any health problems, injuries, or damages that may result from your training, even if you logged those activities using our Service.

3. User Content and Conduct

• Ownership: You retain ownership of the data you input (workout logs, stats). You grant us a license to host and display this content as part of the Service.

• Public vs. Private: By default, your profile is public. You can switch to "Private" in the settings. You are responsible for the visibility of your data.

• Prohibited Content: You may not upload profile pictures or choose usernames that are illegal, offensive, harassing, or infringe on third-party rights (e.g., trademarks).

• Abuse: We reserve the right to remove any content or delete accounts that violate these rules or negatively impact the community.

4. Supporter Tiers and Payments

• Voluntary Support: Nouta is free to use. We offer optional "Supporter Tiers" (e.g., The Spotter, The Training Partner, The Day One) which are voluntary payments to support the development of the app.

• In-App Purchases: Payments are processed via the Apple App Store or Google Play Store (using RevenueCat).

• Refunds: Since payments are handled by third-party stores, any refund requests must be directed to Apple or Google according to their respective policies.

• No Commercial Guarantee: Becoming a Supporter provides cosmetic features or early access, but it does not change these Terms or our liability.

5. Intellectual Property

The design, code, brand "Nouta," and original content of the app (excluding user logs) are the exclusive property of RegenBlau OG. You may not copy, modify, or reverse-engineer the Service.

6. Limitation of Liability

To the maximum extent permitted by law, RegenBlau OG shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, resulting from your use of the Service or any technical malfunctions.

7. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms. You may delete your account at any time as described in our Privacy Policy.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Austria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Vienna, Austria.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the app or email. Continued use of the Service after changes constitutes acceptance of the new Terms.
